What to do in a Slip and Fall Accident

Gather Evidence
  • Obtain names, addresses, and phone numbers of all witnesses right away. If you don’t get this information quickly, you may never have another chance to do so. A witness could be the difference between winning a potential claim or losing one.
  • Take notes on what happened. Record everything you remember immediately. Memories fade over time, so doing so now is critical. Record the weather conditions, what you were wearing (especially your shoes), and all other details about your accident.
  • Take photos of any injuries and any defect or hazardous condition which caused you to fall. Spills are cleaned up and broken stairs are often fixed immediately. It is essential that you record these conditions at the time of your fall so you have this evidence at a later time. Again, if you delay, the evidence may be gone forever.

Report the fall

Report the accident and the dangerous condition to the landowner, store manager, etc. Make sure to obtain the name of this person. If you can, gather insurance information from the property owner. Limit talking to the owner as much as possible: tell them what happened but don’t get emotional or angry.

Seek medical attention immediately if you are injured

If you have any physical complaints after the accident, you should seek medical attention right away. An emergency room can provide immediate evaluation and diagnostic tests such as x-rays.

Don’t leave any complaints unmentioned even if they are minor. You will need to have your injuries and the reason you were hurt documented to receive compensation for medical bills.
