While working as a mailman, the plaintiff sustained back and neck injuries while slipping and falling on the defendant's property. While walking down the stairs to exit the defendant's property, the plaintiff fell down due to a faulty step. The plaintiff was unable to see the condition because the property in question is a nursing home. The nursing home allowed patients to sit on these steps which in turn blocked the view of the plaintiff.
Resulting from the slip and fall incident, the plaintiff sustained several back and neck injuries. They included a disc herniation with radiculopathy which was confirmed positive by an MRI test. In order to treat this injury, surgery was needed, and was performed approximately one year after the incident.
At the time of the fall, the plaintiff was suffering from lower back pain due to a previous automobile accident. He contends that this condition was worsened in the fall. Additionally, the plaintiff also broke numerous teeth which required medical attention.
After receiving surgery, the plaintiff returned to work. Prior to a suit being filed, the plaintiff settled for the amount of $200,000.
