In November of 2002, the plaintiff was walking in the crosswalk across the street next to her apartment building in Virginia when she was struck by the defendant’s vehicle and thrown to the ground. She suffered facial and lip lacerations requiring approximately 70 sutures. In addition, she fractured her nose, and fractured her left fibula and left clavicle, which required two surgeries and extensive occupational therapy.
The plaintiff’s recovery took almost two years with medical bills totalling $105,000 and lost wages of $8,000, and was made more difficult by the fact that she was single, lived alone and had no family in the immediate area.
After a prolonged and intense negotiation, this case settled directly with the defendant’s insurance company down in Virginia without the need for litigation in the amount of $475,000.00.
