Delivery Man Pinned Against Truck - Double Leg Amputation - $3,000,000.00

In 2001 the plaintiff was working his regular job as a furniture deliveryman. While at the rear of his truck looking in, the plaintiff was pinned against the vehicle when the defendant lost control of his car and struck him in the back.

At that time the defendant froze up and went into a state of shock. The plaintiff's co-worker was then forced to pull the defendant out of his vehicle, and to back the truck up in order to free the plaintiff.

When the two vehicles were moved apart, the plaintiff immediately collapsed to the ground. Liability was never an issue even though the plaintiff's truck was parked in the wrong direction, on the wrong side of the road.

During the incident the plaintiff sustained serious injuries to both legs. Injuries included amputation of the left leg above the knee, as well as a tibia-fibular fracture of the right leg. The right leg eventually became infected, and was also amputated.

When the case was settled, the plaintiff was training for a new vocation. He was in a wheelchair as prosthetic devices did not work out. The case ultimately settled for the policy limits of $3,000,000.00. Print this page
