In this case, the plaintiff was struck by the defendant's motor vehicle while riding his bicycle in the street. This resulted in the plaintiff being thrown to the ground.
Liability was contested when the defendant stated that the plaintiff crossed into his path of travel, causing the incident.
During the fall the plaintiff suffered injuries to his right wrist including carpal instability as well as a torn scapholunate ligament. In addition, several contusions and sprains were also diagnosed.
A year after the accident, the plaintiff had to undergo surgery in order to correct the problems in his wrist. This procedure included a radial styloidectomy, bone graft, and debridement of the wrist. The surgery was a success, and the plaintiff's surgeon cleared him to return to work within approximately eight months.
Two weeks before the accident, the plaintiff moved to the United States from a foreign country. Even though he was not employed at the time, the plaintiff argued that he did lose an earning capacity due to the injuries. He was actively pursuing a job as an automobile mechanic, and had successfully interviewed. He stated that he could not take the position that he was awarded due to the injuries that he sustained.
The plaintiff agreed to accept $165,000.00 for payment of his pain and suffering.
