After dark, the 75 year old plaintiff was crossing the street when she was suddenly hit by a car. During the accident the plaintiff sustained several injuries including: hematoma of the head, two open wounds, and fractures of the fibula and tibia bones.
In order to treat the injuries, the plaintiff underwent three separate surgeries. These procedures included blood transfusions, vacuum closure treatment on the wounds, and antibiotic treatments.
As a result of the accident the plaintiff was hospitalized for seven days. From there, the plaintiff was transferred to a rehabilitation establishment for two weeks. After three weeks in the hospital and therapy, the plaintiff was then released but had to continue with outpatient physical therapy for another four months.
In 2005 a suit was filed by the plaintiff. After depositions were taken of both parties, settlement talks began. At this time, counsel for both parties agreed on a payout of $230,000.00 in favor of the plaintiff.
